4.1 Right to Access (Right of Access)
This fundamental right, enshrined in laws like GDPR (Article 15) and CCPA (right to know), grants individuals the ability to request and obtain confirmation as to whether their personal data is being processed, and where that is the case, access to that personal data. Beyond mere confirmation, it entitles individuals to a copy of their personal data, often in a commonly used electronic format, and comprehensive information regarding the processing itself. This includes:
- The purposes of the processing.
- The categories of personal data concerned.
- The recipients or categories of recipient to whom the personal data have been or will be disclosed.
- The period for which the personal data will be stored, or the criteria used to determine that period.
- The existence of the right to request rectification or erasure of personal data or restriction of processing or to object to such processing.
- The right to lodge a complaint with a supervisory authority.
- Information about the source of the data if not collected directly from the individual.
- The existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the individual.
Organizations are typically required to respond to such requests without undue delay and, at the latest, within one month (extendable by two further months for complex requests). This right serves as a prerequisite for individuals to exercise other data subject rights, as one must first know what data is held before seeking to rectify or erase it.

4.2 Right to Rectification (Right to Correction)
Individuals have the right to request the prompt correction of inaccurate personal data and to have incomplete personal data completed, including by means of providing a supplementary statement (GDPR Article 16, CPRA).
This right is critical for ensuring the accuracy and reliability of personal information, which can have significant impacts on an individual’s life, from credit scores to healthcare records. If an organization has shared the inaccurate data with third parties, it is generally obligated to inform those third parties of the rectification, unless this proves impossible or involves disproportionate effort. 4.3 Right to Erasure (Right to be Forgotten)
Often termed the ‘right to be forgotten,’ this right allows individuals to request the deletion or removal of their personal data under specific conditions (GDPR Article 17, CCPA right to delete). It is not an absolute right and must be balanced against other legal obligations or public interests. Key conditions for erasure include:
- The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
- The individual withdraws consent on which the processing is based, and there is no other legal ground for the processing.
- The individual objects to the processing, and there are no overriding legitimate grounds for the processing.
- The personal data have been unlawfully processed.
- The personal data have to be erased for compliance with a legal obligation in Union or Member State law.
- The personal data have been collected in relation to the offer of information society services directly to a child.
Exceptions to this right exist, for example, where the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest in the area of public health, for archiving purposes in the public interest, scientific or historical research purposes, or for the establishment, exercise, or defense of legal claims. When erasure is granted, organizations are also generally required to take reasonable steps to inform other controllers who have processed the data of the individual’s request.

4.4 Right to Restriction of Processing
This right allows individuals to request the limitation of the processing of their personal data in specific circumstances (GDPR Article 18). When processing is restricted, data can only be stored, and generally, other processing operations (like analyzing or sharing) are prohibited unless the individual consents, for legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest. Circumstances justifying restriction include:
- The accuracy of the personal data is contested by the individual, for a period enabling the controller to verify the accuracy.
- The processing is unlawful, and the individual opposes the erasure of the personal data and requests the restriction of their use instead.
- The controller no longer needs the personal data for the purposes of the processing, but they are required by the individual for the establishment, exercise, or defense of legal claims.
- The individual has objected to processing pending the verification whether the legitimate grounds of the controller override those of the individual.

4.5 Right to Data Portability
Introduced by the GDPR (Article 20), this right enables individuals to obtain and reuse their personal data for their own purposes across different services. Specifically, it allows individuals to receive personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format, and to transmit that data to another controller without hindrance from the controller to which the personal data have been provided. It also provides for the direct transmission of personal data from one controller to another where technically feasible.
This right applies only when the processing is based on consent or on a contract, and the processing is carried out by automated means. It aims to foster competition among service providers and empower individuals to switch services more easily by taking their data with them, for example, moving social media profiles or playlists from one service to another.

4.6 Right to Object
Individuals have the right to object to the processing of their personal data based on legitimate interests or direct marketing (GDPR Article 21).
- Objection to processing based on legitimate interests or public tasks: An individual can object at any time to processing based on grounds relating to their particular situation. In such cases, the controller must cease processing the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the individual, or for the establishment, exercise, or defense of legal claims.
- Objection to direct marketing: Where personal data are processed for direct marketing purposes, the individual has the absolute right to object at any time to processing of personal data concerning them for such marketing.
